This Privacy Policy therefore explains how we handle your personal data when we support you in the context of a cooperation, maintain the relationship with you, for example after we have found a job for you, perform a service for you or you perform a service for us, use your personal data to request support in connection with one of our candidates or when you visit our website.

This privacy policy is exclusively applicable to our websites (www.meister-executive.ch and www.meister-networks.ch). We assume no responsibility and accept no liability for links that direct users from our website to third-party websites. 3. Anonymous collection of data

You can visit our website without providing any personal information. We do not store any Personal Data in this context. In order to improve our offer, we only evaluate statistical data that does not allow to draw conclusions about your person.

 

4. Consent for the processing of particularly sensitive personal data

Particularly sensitive personal data are subject to stricter data protection regulations. We therefore require your explicitly given consent in order to be able to process such data. We ask you for your consent in advance, meaning that you are required to provide us with your explicit and unambiguous consent in processing these personal data. We will obtain your consent by providing our privacy policy to you by e-mail, and consider it being accepted by you if you send us your file. The processing of particularly sensitive personal data takes place after receipt of such declaration of consent only.

We treat your candidate profile as a whole as particularly sensitive personal data, as well as we do so with individual information which must be treated more sensitively due to your privacy, such as your curriculum vitae, education certificates and diplomas, information on professional experience, references, skills, hobbies, emergency contacts, residence status or financial and creditworthiness data. 

Furthermore, it is a matter of course that categories of particularly sensitive data, as defined by law, also apply if we collect or receive such data from you, e.g. data revealing racial or ethnic origin, political opinions, religious or philosophical convictions or trade union membership, genetic data, biometric data for unambiguous identification, health data or data on sex life or sexual orientation, as well as data on criminal convictions and criminal offences.

Particularly sensitive personal data will only be collected by MES AG with your express consent and always directly from you.

 

5. Processing of Personal Data

 

5.1 Personal Data via the Website

In the context of your visit to the website, we only collect the data listed below: 

a) All information that you explicitly provide in the context of an inquiry (name, address, age, sex, contact data, etc.);
b) IP address;
c) Browser version and browser type used;
d) Date & time of the visit or request.

Unless otherwise explicitly stated in this privacy statement, the above list is final. It is also possible that we do not collect all of the data mentioned.

 

5.2 Personal Data of candidates

We limit your provision of personal information to the extent necessary to assure a better and more efficient recruitment process on the one hand, or if such need of information emerges from our customers. This includes general personal data, but also personal data that is particularly sensitive.

 

5.3 Personal Data of customers

If you are a customer of MES AG, we collect and process personal data about you or persons within your organisation in order to provide services for you.

Usually, we do not need more than your contact details or the contact details of individual contacts within your organisation (such as their names, telephone numbers and e-mail addresses) in order to ensure a lean business relationship.

 

5.4 Personal data of persons provided by candidates, clients or employees for further information

We only ask for very basic personal information so that we can contact you for a reference, or to get in touch with you due to your person being referred to by one of our candidates or employees.

In order to ask someone for a reference, we need the personal data of such person (e.g. name, e-mail address and telephone number). We also need these details if our candidate or one of our employees has designated you as his/her emergency contact so that we can notify you in the event of an accident or emergency.

 

6. Use of your Personal Data

The processing of your personal data takes place exclusively in the context of the initiation, governance and execution of
a) a request submitted by you;
b) a client mandate; 
c) a recruitment; or
d) for internal statistical purposes.

 

7.    Disclosure to third parties

The processing of your personal data on the website takes place exclusively in the factual context of a request submitted by you, to correct or improve our website or our internal data processing tools, and if necessary for internal statistical purposes.

First and foremost, we pass on the information you send us as a candidate to potential employers in order to increase your chances of finding your desired employment. Unless you have indicated otherwise, we - if we believe that this will help us to provide you with the best possible service - may also share your information with affiliated third parties, e.g. one of our partner companies within the CFR network (www.cfr-group.com), as well as further partners, job portals and job search engines. Such transfer of personal data is limited to affiliated third parties based in Switzerland - should we wish to transfer your information to an affiliated third party abroad, we will ask for your explicit consent in advance. 

Your data will not be forwarded to other third parties without your explicit consent, save our service partners needed to process a contractual relationship (e.g. postal and courier services, financial service providers, authorities in the context of collection measures, etc.). In these cases, we strictly observe the provisions of the applicable data protection laws. The scope of data transmission is limited to a minimum.

Our service partners, which we need for internal data processing, are certified in accordance with the EU-US or US-CH data protection agreement ("Privacy Shield") insofar as they are located in the United States or store data in the United States. These companies thus meet special standards compared to the otherwise customary data protection law in the United States of America. This level of data protection is recognized as equivalent to that of Switzerland or the European Union.

 

8. Cookies

Our Website uses so-called cookies at several points. Cookies are small text files that are stored on your computer and saved by your browser. They are used to make our offering more user-friendly, more effective and more secure. Cookies also allow our systems to recognise your browser and offer you services. 10. Google Maps

We use Google Maps to display interactive maps and to create directions. Google Maps is a map service of Google.

11. Use of Hotjar

We use the web analysis service Hotjar of Hotjar Ltd ("Hotjar") for our website. Hotjar is a European company based in Malta (Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta). With this tool you can track movements on our website (so called heat maps). For example, you can see how far users scroll and which buttons users click and how often. Furthermore, it is also possible to obtain feedback directly from the users of the website with the help of the tool. In this way we obtain valuable information in order to make our website even faster and more customer-friendly.

When using this tool, we pay particular attention to the protection of your personal data. We can only track which buttons are clicked, the mouse movement, how far you scroll, the screen size of the device, device type and browser information, location (country only) and preferred language to display our website.

12. Transmission of Personal Data

E-mails between you and us are stored exclusively on secure servers, but are usually not encrypted. The use of e-mails is technically not secure; it may happen that e-mails are not delivered. When e-mails are transmitted, they may leave national borders, even if the sender and recipient are both domestic. The confidentiality of e-mails cannot be guaranteed if encryption is missing or insufficient, and absolute security is not possible even with encryption. Unencrypted e-mails are therefore not suitable for sending confidential information.

By transmitting an e-mail, you agree to communication via e-mail in full knowledge of the risks described.

 

13. Storage of Personal Data

Our Website is hosted by Weserve AG, Liebefeld (BE). Your personal data collected as part of the activities on the website will be hosted on the servers of Weserve AG in Switzerland. The servers offer the best-possible protection against unauthorised third-party access. Backups are generated regularly in order to prevent data losses to the greatest possible extent. 

As far as your personal data is concerned, which we collect directly, it is stored on our own local servers. The servers are protected as good as possible against unauthorized access by third parties. Backups are created regularly to prevent data loss as much as possible.

 

14. Access, retification, updating

You have the right to free information about your stored data and the right to correction at any time. Please contact us for this. You will find our contact details under point 2 of this privacy policy. 

Unless requested otherwise, your files, including your personal data, will be updated neither automatically nor systematically. However, as soon as your dossier, as stored in our files, is suitable for an open position, we will contact you and, if you are interested in the open position, update your dossier together with you before we will send it to our client. If you are not interested in the vacancy, you have the choice of updating your dossier, keeping it in its existing form or deleting it. To delete your dossier, please also see paragraph 15 below.

 

15. Withdrawal and deletion

Unless requested otherwise, we will not delete your dossier, but store it for as long as we consider it necessary or useful for the provision of our services. Your dossier will be stored in our candidate archive and continuously checked for compliance with the job profiles submitted to us. However, we reserve the right at any time to delete all or part of your dossier without any further correspondence with you. 

In the event that we are no longer able to contact you on the basis of the contact details in your dossier (at the time of contacting you, please note the comments in paragraph 14), we will delete your dossier. 

You can withdraw your consent to this privacy policy at any time and request the deletion of your personal data. Please contact us for this purpose. You will find our contact details under point 2 of this privacy policy.

If you request deletion, we will block your profile. Please note, however, that we are obliged under commercial and tax law to retain accounting records for at least 10 financial years and that other statutory retention obligations may also apply (including indirect retention obligations such as the receipt of documentation for the duration of the statutory limitation period). Therefore and if such retention obligation applies, we can neither delete nor process the personal data contained in these documents. Your request for deletion will therefore only apply to this extent for future processing. 

If a contractual relationship is still pending at the time of receipt of your revocation and deletion request, your personal data will be processed until the contract has been fully processed. Your revocation under data protection law expressly has no influence on the processing of existing contractual relationships and is not regarded as an extraordinary reason for termination.

 

16. Amendments to this privacy policy

Amendments to this privacy policy will apply from the time of their publication on our website. The processing of Personal Data that was collected under the provisions of an older privacy policy will be performed in accordance with this privacy policy.

We reserve the right to amend this privacy policy at any time and to inform users about the changes in an appropriate form.
